TERMS & CONDITIONS OF SALE
WARRANTY
Durango Nursery & Supply, Inc. (Durango Nursery) warrants that nursery stock is true to name and will be in healthy, viable condition when it leaves Durango Nursery grounds. Due to elements beyond our control, when plant material leaves the grounds, no warranty is expressed or implied as to the future health or survivability of the plant material. In the event of failed plant material, Durango Nursery can send an experienced associate of the nursery to do a site visit for inspection, on a case-by-case basis.
PLANT HOLDING POLICY
Some plant material can be held at Durango Nursery for up to 30 days after purchase. Annual plants will not be held. When tagged for holding, this material, plus a Holding Fee, must be paid for in full and becomes the property of the customer. No material will be held without payment. Durango Nursery will be responsible for the health of the material during the initial 30 days. If the plant health fails in this 30-day period, Durango Nursery will replace the product or credit the customer. If material is held for more than 30 days, an Extension Fee of 15% of the purchase price will be charged monthly and plants will not be eligible for return or replacement, even if they have declined in health. Extension Fees must be paid for in full before material can be picked up or delivered. No material will be held past November 1st, regardless of the date it was purchased, even if this period is less than 30 days. After November 1st, any material that has not been picked up will be returned to Durango Nursery with no option for a refund.
PLANT HOLDING FEES
Holding Fees are based on the total price of containerized plants only. Balled and burlapped (B&B) plants do not require a Holding Fee, but will accrue Extension Fees if held beyond 30 days:

HARDGOODS HOLDING POLICY
Hardgoods materials can be held at Durango Nursery for up to 30 days after purchase. When tagged for holding, this material must be paid for in full and becomes the property of the customer. No material will be held without payment. If material is held for more than 30 days, an Extension Fee of 15% of the purchase price will be charged monthly and materials will not be eligible for return or replacement. These Extension Fees must be paid for in full before material can be picked up or delivered. No material will be held past November 1st, regardless of the date it was purchased, even if this period is less than 30 days. After November 1st, any material that has not been picked up will be returned to Durango Nursery with no option for a refund.
RETURN POLICY
Returns will typically be refunded via the original purchase method. Cash returns must not exceed $100, otherwise store credit or a check will be issued. Credit card returns must be refunded back onto the card used in the original purchase. No returns will be accepted on materials purchased at a discounted price, or materials that were a special request (see: Special Requests). All returned material will be subject to a Restocking Fee of 15% of the purchase price. If materials are held for a customer by a Durango Nursery employee sight unseen, the customer is responsible for inspecting the material before it is picked up or delivered.
Balled and Burlapped Plants: Balled and burlapped (B&B) plant material will not be accepted for return if it has left Durango Nursery grounds. Plants that are held at Durango Nursery but returned before they have left the grounds will still subject to the 15% restocking fee. B&B plants that have been held for more than 30 days or beyond November 1st will not be refunded or exchanged.
Container Plants: Containerized plant material must be inspected by a manager to be approved for a return. If approved, a refund will be issued with a 15% restocking fee. If the plant material is not in original condition or in poor health, it will not be accepted for a return. Examples of poor plant conditions include but are not limited to: drought and/or heat stress, scraped bark, broken branches, dried out foliage, etc. Containerized plants that are held at the nursery but returned before they have left the grounds will still be subject to the 15% restocking fee. Containerized plant material that has been held for more than 30 days or beyond November 1st will not be refunded or exchanged.
Hardgoods: Hardgoods products returned to Durango Nursery, regardless of whether they ever left the grounds, must be in original condition and will be returned with a 15% restocking fee. All sales are final on anything cut to order, such as pond liner, geotextile, row cover, and shade cloth.
SALES TAX
Sales tax will be calculated on the total materials, but not services, at a rate of 4.9% (2.9% State of Colorado and 2.0% La Plata County). Materials delivered within the Durango City Limits will be subject to an additional 3.5% sales tax, for a total of 8.4%.
TAX EXEMPT STATUS
Customers that wish to exempt their purchases from sales tax must provide a copy of their Colorado Sales Tax License or Sales Tax Exemption at the time of the sale.
SPECIAL ORDERS
Members of our Landscaper Program can place special order requests. Special orders must be for at least 100 units or $1,000, whichever is less. Placing a request with Durango Nursery does not guarantee that the items can be ordered and is subject to supplier availability and/or substitutions. Special orders may require a 50% deposit at the time of order, with the balance due in full when the material arrives. Products will be tagged for holding upon arrival and will be subject to the terms of the Holding Policies, including Holding Fees. Special orders are not eligible for return.
Landscapers can email their special order requests to [email protected]. Lists should include: Customer Name and Job Name, Preferred Pick-Up Date, Common Name, Latin Name, Variety (if applicable), Size, Quantity, and Substitution Preferences.
